Judge Katherine Forrest, a national heroine to emulate

Judge Katherine Forrest, our new national heroine, someone to emulate. This Constitutionally devoted judge-citizen who struck a true chord in the national body politick with her simple rejection of the smearing of boundaries in our government’s checks and balances. The President, she asserts in her ruling, has no authority to detain US citizens without charge, trial or lawful investigation.


“Late Monday, a federal appeals court judge in New York granted the Obama administration's request for an "emergency" stay of the ruling, by Judge Katherine Forrest of U.S. District Court, who issued a permanent injunction against a provision of the National Defense Authorization Act of 2011 listing conduct that could result in detention without trial. ”

Our forefathers created this way of managing bureaucracy BECAUSE they anticipated that greedy human nature would eventually seep into ideal separation of powers. The executive branch of the Presidency would eventually seek powers not spelled out in the Constitution because of its office’s endemic self-promotion and self-empowering mindset. The Congress, as the Legislative arm of government, ought to tighten the purse strings in order to check the President’s ability to unilaterally bequeath upon its office the power to unconstitutionally detain citizens and act as judge and jury. When the Senate and House work collectively to take away the money to create and maintain “blacksite” prisons or extrajudicial, supra-national detention centers around the world, they reinforce their original constitutional purpose. The Judiciary, from its position of lifetime appointments and blind justice, must affirm the fundamental constitutionality of these aforementioned principles through its unbiased observation and analysis from the bench.


Unabridged by political slant or status quo thrusts, or, more likely, in spite of them, the system works due to its delicate balance of responsibilities and duties. The President, the members of Congress and the Supreme Court all work at the pleasure of one sole group: the People of the United States. All 100% of us. When we see that one branch or another is overstepping its boundaries, we are OBLIGATED to speak up, to shake up the system at its roots, be it through lawsuits, the Occupy movement, the ballot box, etc. That is our charge as the citizens of this country. It is our responsibility not only to ourselves, but to future generations.


If we choose not to raise these crucial points of law that dictate how the system should work, then we forfeit our investment in it and foreclose on our own national future, imprisoning the character of our national heritage and retarding the meaning of democracy. If we do nothing, then the powers that be will not merely encroach on federal powers. They will devour whatever they can in order to appease the puppeteer 1% billionaires.


America cannot allow itself to become a farce of what once was a great, promising nation. “The Land of the Free and the Home of the Brave” premise only works when we work to protect our freedoms, when we are brave enough to defend them. Implosion of an empire is the fate we are heading toward if we don’t check these underpinnings of our government.
